Acceptable Use Policy
1. Overview
This Acceptable Use Policy ("AUP") describes conduct that is prohibited on the DrinkUp Platform. It is part of, and incorporated by reference into, our Terms of Service. By using the Platform, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account, refusal of pending or future orders, refund denial, and reporting to law enforcement or other authorities where applicable.
Capitalized terms used here have the meanings given in the Terms of Service ("Platform," "Bar," "Customer," "DrinkUp," etc.).
2. Who This Policy Applies To
This AUP applies to all users of the Platform, including:
- Customers placing orders;
- Visitors browsing the Platform without an account;
- Anyone interacting with the Platform's APIs, services, or content.
Bars participating on the Platform are subject to separate obligations under their Bar Partnership Agreement; this AUP supplements but does not replace those obligations.
3. Age and Identity
You will not:
- Use the Platform if you are under 18 years of age (the minimum age to use the Platform at all);
- Order any alcoholic beverage if you are under 21 years of age (the legal drinking age in the United States and the State of Florida under Fla. Stat. § 562.11);
- Misrepresent your age, identity, location, or any other material information when creating an account or placing an order;
- Use someone else's identification, payment method, or account to circumvent age verification;
- Order alcoholic beverages on behalf of, or for delivery to or consumption by, any person under 21;
- Create an account for, or place an order on behalf of, any person under 21 to receive alcohol;
- Assist any person in violating any of the above.
Misrepresenting your age to induce a licensee to serve you alcohol is a violation of Florida law (Fla. Stat. § 562.11(2)). Violations of this Section 3 will result in immediate account termination and may be reported to law enforcement and to the Florida Division of Alcoholic Beverages and Tobacco.
4. Accounts
You will not:
- Create more than one DrinkUp account for yourself;
- Create an account using false information;
- Create an account on behalf of another person without their express authorization;
- Share your account credentials with anyone;
- Use someone else's account;
- Create an account after a prior account of yours has been terminated by DrinkUp for cause, except with our prior written consent.
5. Payment and Fraud
You will not:
- Use a payment method that you are not authorized to use;
- Submit fraudulent or stolen payment information;
- Engage in chargeback fraud, including initiating a chargeback for an order you actually received, for a pickup refused for reasons within your control under our Refund Policy, or as a means of obtaining a free order;
- Attempt to manipulate, exploit, or abuse the Platform's pricing, fee structure, promotional offers, or refund policies;
- Use the Platform to launder money or process payments unrelated to legitimate Bar orders.
We use fraud-detection tools and may share information about suspected fraud with our payment processor (Stripe), other fraud-prevention services, and law enforcement.
6. Conduct Toward Bar Staff and DrinkUp Personnel
You will treat Bar staff, DrinkUp personnel, and other Customers with respect. You will not:
- Harass, threaten, abuse, intimidate, or use profanity or hostile language toward Bar staff, DrinkUp personnel, or other Customers, whether at the Bar, on the Platform, by email, by phone, or through any other channel;
- Discriminate against any Bar staff, DrinkUp personnel, or Customer on the basis of race, color, religion, sex, national origin, age, disability, sexual orientation, gender identity, marital status, or any other characteristic protected by law;
- Make threats of physical harm, retaliation, or property damage;
- Engage in any conduct at the Bar that violates the Bar's house rules, dress code, or other reasonable policies;
- Refuse to leave a Bar's premises when asked to do so by the Bar's staff.
Bar staff have full discretion under Florida law (Fla. Stat. § 561.11 and related provisions) and their own house policies to refuse service, deny entry, or remove anyone whose conduct is unwelcome. DrinkUp supports those decisions.
7. Technical Conduct
You will not:
- Use any robot, spider, scraper, crawler, or other automated means to access, monitor, copy, or extract data from the Platform, except with our prior written consent;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Platform;
- Bypass, disable, or attempt to circumvent any technical measure intended to protect the Platform or restrict access to it;
- Probe, scan, or test the vulnerability of the Platform or any related system without prior written authorization;
- Attempt to gain unauthorized access to any account, system, or network connected to the Platform;
- Introduce any virus, worm, malware, ransomware, time bomb, trojan, or other malicious code into the Platform;
- Use the Platform to transmit unsolicited commercial communications, spam, or phishing content;
- Attempt to overload the Platform through excessive request rates, denial-of-service attacks, or any other means;
- Frame, mirror, or scrape any portion of the Platform without our prior written consent;
- Impersonate DrinkUp, a Bar, or any DrinkUp employee or contractor.
8. Commercial and Re-Sale Restrictions
You will not:
- Resell, redistribute, or commercially exploit any order, product, or content obtained through the Platform;
- Use the Platform to operate a competing business, including by placing orders to gather Bar menu, pricing, or operational data;
- Use DrinkUp's name, logo, or trademarks for any commercial purpose without our prior written consent;
- Promote, advertise, or solicit on the Platform without our prior written consent.
9. Content You Submit
If you submit content to the Platform — including reviews, ratings, photos, profile information, or messages — you will not submit content that:
- Is false, misleading, or fraudulent;
- Defames any person, Bar, or business;
- Infringes any third party's intellectual property, privacy, publicity, or other rights;
- Contains personal information about other people (their name, contact info, photograph, etc.) without their consent;
- Is obscene, sexually explicit, or otherwise inappropriate;
- Promotes violence, hatred, discrimination, or illegal activity;
- Is intended to deceive other Customers about a Bar's products or service quality (including coordinated review manipulation, whether favorable or unfavorable);
- Contains malicious code, links to malicious sites, or unauthorized advertising.
We may remove any submitted content at our discretion and may suspend or terminate accounts that repeatedly submit prohibited content.
10. Compliance with Laws
You will use the Platform in compliance with all applicable federal, state, and local laws, including but not limited to:
- The Florida Beverage Law (Fla. Stat. Chapters 561-565), including the prohibition on furnishing alcohol to minors;
- Open-container, public-intoxication, and DUI/DWI laws;
- Tax laws (including the obligation to pay applicable sales tax shown on your order);
- Anti-discrimination laws;
- Anti-fraud and consumer protection laws.
You will not use the Platform to facilitate, plan, or carry out any illegal activity.
11. Reporting Violations
If you believe someone is violating this AUP — including underage ordering, fraudulent payment activity, abusive conduct, fake reviews, or any safety concern — report it to:

Please include as much detail as possible: usernames, order numbers, dates, descriptions, and any evidence. We investigate every report.
If you witness conduct at a Bar that raises an immediate safety concern (assault, intoxicated driving, etc.), call 911 first, then report to DrinkUp.
12. Enforcement and Consequences
Violations of this AUP may result in one or more of the following, at DrinkUp's discretion:
- Warning;
- Removal of submitted content;
- Restriction of specific Platform features;
- Suspension of your account, temporarily or pending investigation;
- Termination of your account;
- Denial of refunds for orders affected by the violation;
- Recovery of any losses, fees, or costs incurred by DrinkUp or any Bar as a result of your violation;
- Reporting to law enforcement, regulators, payment networks, or other authorities;
- Cooperation with any investigation initiated by a third party.
DrinkUp's decision to enforce or not enforce this AUP in any particular instance does not waive our right to enforce it in any other instance. Our remedies under this AUP are cumulative with all other remedies available to us under the Terms of Service and applicable law.
13. Changes to This Policy
We may update this AUP from time to time. When we make material changes, we will update the "Last Updated" date above and provide notice through the Platform. Continued use of the Platform after the effective date of changes constitutes acceptance.
